Circuit Court Vacates Stay of OSHA COVID Vaccine Mandate

As you may have seen, the 6th Circuit Court of Appeals late yesterday (12/17/2021) vacated the stay of OSHA’s Emergency Temporary Standard (ETS). Here is a link to the Court’s decision. Several petitions have already been filed with the Supreme Court seeking to block the mandate.

OSHA released a statement that reads in part, “…OSHA will not issue citations for noncompliance with any requirements of the ETS before January 10 and will not issue citations for noncompliance with the standard’s testing requirements before February 9, so long as an employer is exercising reasonable, good faith efforts to come into compliance with the standard.”
